At
the Founding Assembly of The Citizens'
Alternative Parliament of Bosnia and
Herzegovina held on August 31, 1996
it was decided upon the following
S T A T U T E
OF THE CITIZENS' ALTERNATIVE PARLIAMENT
OF BOSNIA AND HERZEGOVINA
I GENERAL PROVISIONS
Article
1
The
Citizens’ Alternative Parliament of
Bosnia and Herzegovina is the Association
of Citizens organised by individuals
and collectives determined for sovereign
and politically independent Bosnia
and Herzegovina within its internationally
recognised borders, on the basis of
reconciliation among the citizens
and nations and the development of
the democratically oriented civic
society, based on the respect of human
dignity, freedom and equality.
Article
2
The
name of the Association is: the Citizens’
Alternative Parliament of Bosnia and
Herzegovina.
The abbreviated name is: CAP BiH.
The headquarters of the Citizens’
Alternative Parliament is in Tuzla,
St. Titova 1.
Citizens’ Alternative Parliament acts
on the territory of the State of Bosnia
and Herzegovina.
Article

CAP
BiH has its seal and stamp. The shape
of the seal is round; its diameter
is 30 mm and contains the name and
the headquarters of the Association
in Serb/Croatian/Bosnian language,
written in Latin and Cyrillic letters.
The shape of the stamp is square;
its dimension is 40x30 mm and contains
the headquarters and the name of the
Association, as well as the mark for
document number and date.
The use of the seal and stamp is to
be regulated by separate instructions
upon which the Presidency of CAP BiH
decides.
II OBJECTIVES AND ACTIVITIES OF CAP
BiH
Article
4
Principles and objectives of the CAP
BiH are the following:
· Sovereignty, internationally recognised
borders and political independence
of Bosnia and Herzegovina;
· Bosnia and Herzegovina with such
an inner organization that enables
intensifying of peace and democratic
initiatives within a pluralistic society,
equality of all citizens in realization
and protection of human rights and
elementary freedoms within the internationally
recognized standards, full national
equality and development of local
autonomy;
· The rule of law and social justice;
· Economic development through the
protection of private property and
market economy;
· Freedom of expression and media;
· Freedom of movement, goods and capital
on the whole territory of Bosnia and
Herzegovina.
Among the principles and objectives
established by the paragraph 1 of
this Article, the Founding Assembly
of CAP BiH makes the Charter of the
Alternative Parliament of BiH, which
will serve as the basis and the direction
of the activities and work of the
CAP BiH members and boards.
Article

In
order to realize all of its program
objectives, CAP BiH will do the following:
· Organize public debates, round tables,
seminars and training;
· Demand from the responsible state’s
authorities to take special measures
and activities provided by the jurisdiction
system and the execution of the law
regulations which it deems necessary
for realization and protection of
democracy, human rights and basic
freedoms;
· Inform the public about its activities
and attitudes assumed, especially
when it concerns the illegal work
of the government and socially dangerous
behaviour of political parties;
· Co-operate with international associations
from other countries whose program
objectives are determined by the development
of democracy and fight against any
way of discrimination.
III MEMBERSHIP IN THE CITIZENS ALTERNATIVE
PARLIAMENT OF BiH
Article
6
Members of CAP BiH can be all citizens
of Bosnia and Herzegovina who accept
the purpose of its founding, as well
as its program objectives.
The citizens of Bosnia and Herzegovina
who are members of some other citizens’
associations established in accordance
with the valid propositions, can decide
to join CAP BiH collectively, as members
of the respective association.
Article
7
Rights of the members of CAP BiH are
as follows:
· To take part in the work of CAP
BiH;
· To vote and be elected in the CAP
BiH boards;
· To make objections on the work of
the CAP BiH boards and give proposals
for that work;
· To participate at training, seminars,
consulting and other meetings organized
by CAP BiH.
Article
8
The duties of the CAP BiH members
are:
· To take part in the work of CAP
BiH;
· To support the realization of the
Program objectives and tasks of CAP
BiH, as well as of the decisions and
conclusions of its organs.
Article
9
The membership in CAP BiH ceases in
the cases of:
· Resignation;
· Death;
· Dismissal because of the serious
violation of the Program principles,
work regulations and the activities
of CAP BiH;
Only the Presidency of CAP BiH can
make the decision on dismissal from
the membership.
The appeal against the decision on
the dismissal can be submitted to
the Parliament of CAP BiH within 30
days from the day of the receiving
of the decision.
The decision of the Assembly is final.
Article
10
A foreigner who especially contributed
with his work and activities to the
general principles and Program objectives
of CAP BiH can become an honorary
member of CAP BiH.
The CAP BiH Presidency makes the decision
regarding the reception of the foreigner
as an honorary member.
IV CAP BiH ORGANS
Article
11
The CAP BiH organs are:
· Assembly of CAP BiH;
· Presidency of CAP BiH;
· Supervisory Board and
· Commissions.
Article
12
The Assembly of CAP BiH can convoke
the Assembly of CAP BiH.
Regular Assembly Session is to be
held at least once a year, and special
ones according to the needs.
The Assembly of CAP BiH establishes
the number of the delegates for the
Assembly Sessions at least three months
before the date fixed for gathering
of the Assembly of CAP BiH, and according
to the criteria, which already established
by its general acts.
The operating procedure of the Assembly,
as well as its making of the decisions
should be precisely described as well.
Article
13
The Assembly can hold its Sessions
if the majority of its delegates from
the last paragraph 3, Article 12,
are present.
The Assembly makes the decisions by
public voting.
The complete Executive Council chairs
the Assembly sessions. The members
of CAP BiH appoint the Council members
among themselves.
Article
14
The Assembly of CAP BiH:
· Provides the Statute, as well as
its changes and annexes;
· Makes the operating procedure of
its work, Program of Activities and
adopts the reports on the work of
respective CAP BiH organs;
· Makes a financial plan and confirms
the final financial journal;
· Appoints and dismisses the members
of the Presidency of CAP BiH, Supervisory
Board, Commissions and other working
boards formed according to this Statute
and other general acts;
· Makes the decisions upon the appeals
against the decisions of the Presidency
of CAP BiH;
· Makes the decisions whether the
CAP BiH is to join other international
associations or not;
· Makes the decision on the cessation
of the work of the CAP BiH.
Article
15
The Presidency is the Executive Board
of the Assembly of CAP BiH and consists
of 15 members, whose mandate lasts
two years.
Article
16
At
their first session the Presidency
Members should appoint the President
among themselves, two Vice-Presidents,
Presidents of the Commissions, Secretary
General and the Treasurer of CAP BiH,
who make the Secretariat of CAP BiH
at the same time.
Article
17
The Presidency can hold its sessions
if the majority of its members are
present and it makes decisions with
the majority of votes of the members
present.
Article
18
The Presidency executes the decisions
made by the Assembly and operates
the work of the CAP BiH between the
two Assembly sessions.
The Presidency is especially engaged
in the following issues:
· Making of the Statute Proposal,
its changes and annexes;
· Providing of the operating procedure
of its work;
· Making of the Proposals of the Programme
Activities of CAP BiH;
· Making of the Proposal of the financial
plan and final financial journal,
and has the funds established by the
financial plan at its disposal;
· Deciding on the receiving of new
members of CAP BiH;
· Organizing of training, seminars,
consulting and research travels;
· Forming of the expert groups;
· Co-ordinating of the activities
concerning publishing activities of
CAP BiH.
The President of the Presidency is
the official representative of CAP
BiH and its President at the same
time.
Article
19
The Secretary General of the Presidency
is the Secretary General of the CAP
BiH Assembly at the same time.
The Secretary prepares sessions of
the Presidency and the Assembly according
to the report on work and he assists
the President in his work and also
executes the other tasks committed
to him by the Presidency and the Assembly.
In the case of the Secretary’s absence,
a member of the Presidency appointed
by the Presidency is to replace him.
The Secretary is responsible for his
work to the Assembly and the Presidency.

20
The Assembly appoints three persons
from the CAP BiH members as the members
of the Supervisory Board for the period
of two years and the members of the
Supervisory Board appoint their President
among themselves.
Article
21
The Supervisory Board controls the
material and financial state of CAP
BiH once a year. About its work and
eventual objections the Supervisory
Board submits the report to the Assembly
of CAP BiH.
V PUBLIC OF THE WORK OF CAP BiH
Article

The work of CAP BiH is public.
The public of the work is realized
by mass media.
VI MEANS FOR CAP BiH'S WORK
Article

CAP BiH obtains its means for work
through:
· Donations of physical and juristic
persons, if they do not influence
on the independence of the work of
CAP BiH and its members;
· Funds obtained from publishing activities
and manifestations organized by CAP
BiH.
All financial and material means of
CAP BiH are to be dealt with in accordance
with legal regulations.
The Presidency takes care of the income
and expenditure of CAP BiH.
The Presidency makes the record of
the whole property of the Association
and its value is to be a component
part of the annual balance.
Article 24
CAP BiH has its bank account.
Article
25
The payment warrant can be issued
only by the President of the CAP BiH
Presidency and is to be signed by
two more persons in charge of it.
VII CESSATION OF WORK OF CAP BiH
Article
26
CAP BiH ceases to exist:
· By the decision of the Assembly
of CAP BiH;
· If the number of its members decreases
to less than 30 persons;
· If the competent authorities ban
its work.
Article
27
If CAP BiH ceases to exist, the President
of CAP BiH will submit the request
to the competent authorities to erase
the CAP BiH from the registration
list and the Presidency will decide
upon its property.
VIII WAY OF PROVIDING OF THE STATUTE
AND MAKING ITS CHANGES AND ANNEXES
Article
28
The Assembly of CAP BiH can pass the
Statute of the Citizens’ Alternative
Parliament of Bosnia and Herzegovina.
The Presidency of CAP BiH makes the
Statute Proposal.
The Statute is to be considered as
approved if at least two thirds of
the Assembly members agree with the
proposal.
The procedure for making of the Statute
is to be applied also in the case
of making changes or annexes to this
act.
XI TRANSITION AND FINAL PROVISIONS
Article
29
This
Statute goes into effect on the day
of its approval and will be announced
on the information board of CAP BiH.
