The second public tribune was held in Livno, in the hall of the Forum Business Centre, with the support of partner organisation "Centre for Civic Cooperation Livno", which is also dealing with the issue of the local government in the past few years, both at the local and cantonal level.
According to our information, the process of development of the local government in this canton is bit slowly. Namely, pre-war ways of organisation of the citizens in the neighbourhood associations do not exist any more, and their renewal and development of the local government if yet to take hold, although the new Federal Law on the Principles of the Local Government is imposing it.
The speakers at the tribune were the President of FTC, Mr Vehid Sehic and Prof. Slavo Kukic, sociologist, who is involved in the process of the development of the local government as analyst.
 Mr Sehic pointed out the reasons for implementation of this project and the aims of the project that want to be achieved. Mr Sehic stressed that this draft of the Law, which will me made by the expert team, must have, and must respect the regulations of the European Charter on Local Government from the articles 2, 9 and 12. That should introduce European standards that will surely result in changes of many other laws (as the Law on Budgets in F BiH and RS; Law on belonging of the public income, Law on territorial structure of municipalities and cities, etc.) that regulate rights and obligations of the municipalities and cities. Those changes should definitely lead to abolishment of the municipalities that have been established after the war on pure ethnical principle and even 11 years after the war they are not able to finance themselves, but they are completely financed from the budgets of the higher levels of the authorities. This law should impose introduction of the basic principles of the structure of the units of the local government and enable their financing.
Prof. Kukic informed the participants of the public tribune about the importance and aims of the European Charter on Local Government. He also gave a short analysis of both entity laws on local government. He pointed out that neither of them did completely applied the European Charter on Local Government, and that over 60% of the citizens are not at all informed about the essence of the regulations of this Charter. Prof. Kukic also pointed out that both entity laws have restrictive relation toward the possibility that big cities in BiH get the status of the city. Speaking about the structure of the employees in the municipalities in both entities, which changed after the war, Prof. Kukic pointed out that it is mostly inappropriate, with the strong influence of the politics, not of the professionalism. In addition, RS Law starts from the citizens, while the European Charter starts from the local authorities and it establishes rights of the local authorities, while according to the Law on local government in RS, the local government is the right of the citizens. In F BiH, the situation is completely different. According the Federal Law, the right has been given to the municipalities to regulate participation of the citizens in direct process of decision-making in the local community, but in F BiH there is no authorised institution for the local government at any of the levels of the authority. So, Prof. Kukic thinks that in F BiH it is necessary to establish department or ministry, which will deal with the local administration and local government and support their development.
Prof. Kukic stressed the necessity for bringing of the state Law on local government. This law should regulate the relations between legislative authorities and mayors, since the practice showed that after adopting of the Law on direct election of the Mayor in F BiH, Mayors as representatives of the executive authorities directly elected by the citizens, have placed themselves higher than legislation authorities and, according to Prof. Kukic’s opinion, taken more authority than belongs them. Speaking about the legislation authorities, yet they have not overcome frames of their political parties and their aims, and they are neglecting needs and interests of the citizens and the local community. Due to all these reasons, Prof. Kukic believes that regulation of the local government at the state level is necessary step toward constitutional changes, since they are dealing with existential issues of BiH citizens. That is why he believes that the constitutional changes should start from the local government. If that is not a case, there will be citizen inequality in BiH. Speaking about the local communities, their right on inter-entity cooperation (as the conditions in BiH impose) and cross-border cooperation, as it is guaranteed by the European Charter, will not be implemented since there is no legal base for it, due to lack of the law and authorised state institution. Although it is stated in the entity laws, municipalities cannot implement that right.
After two hours of discussion and presentation of the opinions, attitudes and proposals of the participants of the public tribune, the conclusions could be:
- related to the local government, it is necessary to take over the authority from the cantonal level and transfer it to the entity, i.e. state level and local community level;
- through this law, local communities should be enabled to make inter-entity, cross-border and regional agreements on cooperation;
- the relation between legislative authorities and mayors has to be completely regulated, since the practice showed many legal indistinctness related to the authorities of those two bodies in the local community:
- the Union of the Cities and Municipalities is overcame, since it does not deal with the interest of the local communities.
